Kwanza is a Limited Liability Company with a capital of 350,000 Euros, registered with Commercial and Companies Registry of Lille Métropole under the number: 488 842 055, whose principal place of business is located at 122 avenue Charles de Gaulle, 92200 Neuilly-sur-Seine, France. Kwanza has created an online screening
room service that is available on its website kwanza.fr for media professionals who are registered users of the service
which utilizes streaming technology so they can view trailers or full-length audiovisual Works in its catalogue. The protected
audiovisual content may be accessed subject to prior approval of registrations and observance of these General Terms of Use.
This screening room service was designed solely for promotional purposes to give media professionals the opportunity to view
the audiovisual content in Kwanza’s catalogue so that they can license it. This website is therefore not designed to sell content
online to private individuals or to professionals. Any media professionals who want to buy one or more of our programs should
contact Kwanza directly about acquiring licensing rights. These General Terms of Use were last updated on 23rd December 2022.

Before they can access the website, users must first set up an account by providing the required information on our online
registration form, giving their: giving their: last name, first name, company name, email and password. Only media professionals who want to acquire licensing rights are eligible to register on our website. Kwanza
reserves the right to refuse any registration of persons or organizations if it deems that their business or motivations
are not consistent with the purpose of the screening room. After Kwanza’s approval, a user ID and password
(hereinafter the « identifying data »), strictly for personal use, will be sent to Users by email confirmation to the email
account provided when they registered. After identifying themselves using their identifying data, users will be able to see
the content that they can view free-of-charge, subject to observance of the terms provided in section 4 below. Users guarantee
Kwanza against any deceitful use and/or source of harm of its identifying data, regardless of whether they are fraudulent, by
their own action or by action of any other party. Kwanza may not be held liable for any unauthorized use of users’ identifying data and/or identity. If users notice any fraudulent use of their identifying data, they must inform Kwanza of this immediately
by email at the following email address: webmaster@kwanza.fr Kwanza reserves the right to close users’ accounts at any time.
Given the nature of the service, Kwanza can not guarantee that the website will function continuously without error or alteration
and can not guarantee that access to the catalogue will be possible, in particular in case of: Improper use of the website
due to inappropriate equipment A malfunction attributable to users’ internet service provider Overloading of the Internet
Force majeure Kwanza may temporarily shut down the website in order to upgrade it or to perform maintenance.
Access to this website is strictly reserved for Users to view the streaming content using only the media player supplied
by the website. The content is available to users free-of-charge for the sole purpose of promoting Kwanza’s catalogue and to
allow users to view them in order to purchase them. Therefore, content can only be viewed by identified users for strictly
professional and non-commercial use. Accordingly, users must agree not to do any of the following: use any technology to
copy all or any of the content feature, cause to feature, use or perform the streaming content taken from the website for
third-parties, either on a commercial or noncommercial basis reproduce or capture in any format whatsoever all or part of
the content create or cause to create on or via a website other than Kwanza’s a link making it possible to view the content
Users agree not to use any technology intended to disorganize, diminish or prevent the normal functioning of the website.
The structure of this website, as well as all audiovisual works and content available on the site and their components (text, graphics, symbols, signals, sounds, images, etc.), are protected under intellectual property law and cannot be used without the prior written consent of the company Kwanza.
Where necessary, the company Kwanza hereby objects to any digital copies or reproductions of these audiovisual works, content, and/or any of their components protected by copyright (text, graphics, symbols, signals, sounds, images, etc.) for the purpose of text and data mining, especially by an artificial intelligence (AI) system, as defined by Articles L. 122-5-3, III and L. 211-3, 8° of the French Intellectual Property Code (CPI), which transposes Directive (EU) 2019/790 of April 17, 2019, on copyright and related rights in the Digital Single Market.
Article R. 122-28 of the CPI specifies that this objection "does not need to be justified and can be expressed by any means. For content made available to the public online, this objection can notably be expressed through machine-readable methods, including metadata, or through the use of general terms and conditions of a website or service."
It is recalled that, in the context of its activities, the company Kwanza may authorize its contractual partners and/or online press services to use audiovisual works, content, and/or any of their components protected by copyright (text, graphics, symbols, signals, sounds, images, etc.) present on the website strictly to the extent necessary for the authorized use. However, such authorizations do not permit these partners and/or online press services to create digital copies or reproductions of these works and/or their components for text and data mining purposes, nor to allow third parties to do so, especially AI systems.
Consequently, any text and data mining operations by an AI system using the audiovisual works, content, and/or any of their components protected by copyright (text, graphics, symbols, signals, sounds, images, etc.) available or made accessible to the public online on this site or by third parties—whether this availability is in extracts or entirety, free or paid—constitute acts of infringement, punishable under Articles L. 331-1 and following of the CPI, unless prior written consent is obtained from the company Kwanza (or, where applicable, the collective management organization to which the company Kwanza has expressly granted a mandate for this purpose).
